Chapter 8.20 LIQUOR LICENSE REGULATIONS
8.20.020.390 Theatrical and production event facility.
A “theatrical and production event facility” means a permanent
structure whose primary purpose is to create an environment for custom
theatrical performance events available only for private functions. A separate
general theatrical and production event facility license as specified in Chapter
6.12 of the Clark County Code is required and must be obtained prior to the
issuance of any liquor license. Examples of theatrical and production event
facility usage include, but are not limited to: theatrical and celebrity
production rehearsals; political and charitable events; marketing of corporate
products; showcasing of theatrical interior design aspects and capabilities, new
technology, lighting and audio; and work shopping of theatrical
performances.
To qualify as a theatrical and production event facility the
establishment must have all of the following: a seating capacity for a minimum
of five hundred fifty persons at one time when configured for auditorium style
seating and a minimum capacity of four hundred persons when configured for
seating at tables; a minimum of nine thousand square feet; and a minimum
investment or market value appraisal of one and one-half million dollars in the
real property, improvements and personal property. The appraisal report must be
prepared by a state certified appraiser and must reflect a value on a date that
is within sixty days of board consideration of the applicable liquor license
application for the theatrical and production event facility. The business,
physical premises, and the land upon which the theatrical and production event
facility is located must be owned by the licensee.
A theatrical and
production event facility is eligible for the following types of liquor
licenses: full bar, service bar, and portable bar.
The liquor license(s)
held by the theatrical and production event facility may only be used for
private functions and shall not be open to the public.
The theatrical and
production event facility is not eligible to receive any gaming license or
provide any entertainment or activities that require licensure as an adult
entertainment cabaret.
No promoters or outside event companies may produce
or execute any event (entertainment or decor) at the theatrical and production
event facility. The licensee of a theatrical and production event facility may
not lease or otherwise allow the licensed premises to be used by another
promoter or event company for any purpose whatsoever. (Ord. L-232-05
